FondCircle App & Health Data Privacy Notice

Last updated: September 23, 2026
Effective date: September 23, 2026

This App & Health Data Privacy Notice (“Notice”) explains how FondCircle Inc. (“FondCircle,” “we,” “us,” or “our”) collects, uses, shares, and retains personal information when you use the FondCircle mobile application and supported connected consumer health devices that sync with the App (the “App”).

Please read this Notice together with our website Privacy Policy. The website policy also covers fondcircle.com, store purchases, marketing, and cookies on the website. This Notice is the App-specific explanation of health, device, and mobile data.

FondCircle Inc. is not a licensed healthcare provider, insurer, or pharmacy, and this Notice is not a HIPAA Notice of Privacy Practices. We do not claim that the App is HIPAA certified, HIPAA compliant, or a substitute for clinical care. Device regulatory status follows each product’s labeling and is not decided by this Notice.

2. Scope and what this App does not do yet

This Notice applies to information we process through the App and through devices you pair with the App. It does not currently cover: booking visits with clinicians; telehealth; sharing your records with a selected healthcare provider as part of an in-App care visit; or household/kiosk use of an AI Health Hub. If those products launch, we will update this Notice and request any additional consent the law requires.

3. Definitions

Personal Information means information that identifies, relates to, or can reasonably be linked to you.

Health and Wellness Data means information about your health, body measurements, device readings, activity, sleep, medication reminders, or similar records in the App. This may be sensitive personal information under U.S. state laws.

Device Data means hardware and software identifiers and diagnostics (for example model, firmware, OS, serial or MAC address where collected for pairing/support, app version, crash logs).

4. Information we collect

What we collect depends on the features you use.

4.1 Information you provide

• Account and profile: name, date of birth, sex/gender you select, profile photo, email, phone number, postal code, country, and authentication identifiers (including if you sign in with Apple or Google).
• Health profile and logs: height, weight, and other measurements you enter; heart rate, HRV, blood pressure, blood glucose, SpO₂, temperature, body composition, HbA1c-related values if you record them, menstrual-cycle information if you use that feature, mood, breathing, stress, and sleep logs; fitness and nutrition entries (activity type, steps, distance, food or water you log).
• Medication reminders: medication name and schedule details you enter. This is a self-management tool, not a pharmacy or prescribing service.
• Family or dependent profiles: information you enter about people you add, which may include health data. You must be authorized to provide it.
• Support and files: messages you send to support, and photos or files you upload.
• Preferences: notification and unit settings, language, marketing opt-in if you give it in the App.

4.2 Information from devices and the App automatically

• Use of the App: screens and features used, frequency, duration, settings, and error messages.
• Device Data: as needed to pair, sync, update, and support devices — including identifiers such as MAC address or serial number when the device provides them.
• Connectivity: Bluetooth and local network signals used to find and maintain a connection. Precise geolocation is collected only if you grant permission and a feature needs it (typically nearby-device discovery). You can refuse; pairing may be limited. We do not require continuous GPS tracking to use the App generally.
• Push and diagnostics: device token for notifications; crash and performance data.
• Cookies / local storage: the App and linked WebViews may store small identifiers.

4.3 Information from integrations you turn on

If you connect Apple Health, Google Health Connect, or another device/app, we receive the categories you authorize there. Those platforms have their own policies.

5. How we use information

We use App information to: create and secure your account and pair devices; display your records, trends, reminders, and exports you request; provide in-App informational insights or chat, if enabled for you; send service notices and optional marketing if you opt in; improve reliability, fix bugs, and understand aggregated, de-identified usage; detect fraud, abuse, and security incidents; and comply with law and enforce our terms.

We do not use Health and Wellness Data to train AI or machine learning models unless you later give a separate explicit opt-in (not currently offered). We do not use Health and Wellness Data for third-party advertising. We do not sell your personal information.

6. AI Health Insights

If available, AI features may summarize patterns or answer questions about records you have in the App. They are informational only. Do not enter another person’s information unless you are authorized.

7. How we share information

We share information with processors that host the App, store data, send email or push notifications, provide crash reporting, or (for non-health analytics) help us understand App performance; with payment and app stores for purchases you make; with integrations you authorize; with people you choose when you export or share; and as required for legal, safety, and business transfers. We do not share Health and Wellness Data with advertising networks. Analytics and crash tools must not be used as a pipeline for detailed health readings.

8. Retention and deletion

We keep personal information only as long as needed for the purposes in this Notice, or as required by law. This Notice does not set a fixed multi-year clinical retention period for App health files.

8.1 While your account is open

Profile, Health and Wellness Data, medication reminders, family or dependent profiles you created, files stored in the account, and AI prompts or responses stored with the account (if that feature is on) stay while the account is active. Where the App shows a delete control, you can delete that item yourself (for example a reading, a reminder, a medication you added, or a photo or file). We then remove it from the active account, subject to the backup and exception rules below. The App does not include a control to delete the whole account. Use the email process in Section 8.2.

Device diagnostics, crash logs, push tokens, and security logs are kept only as long as needed for support, security, and operations, then deleted or de-identified. They are not kept as a permanent copy of your health records. Purchase and subscription records are kept as required for tax, accounting, fraud prevention, and app-store rules, including after the account is closed. Aggregated or de-identified data may be kept for product improvement and is not kept in a form that reasonably identifies you. Copies already in Apple Health, Google Health Connect, or another service you connected are controlled by that service. Deleting data in FondCircle does not delete it there.

8.2 How to delete your account

1. Email privacy@fondcircle.com from your registered email, or from another address if you include the registered email. State that you want the account deleted. You may also email support@fondcircle.com.
2. We verify that you are the account holder. If we cannot verify the request, we will not delete the account.
3. After verification, we delete or de-identify the account data in our active systems, including dependent profiles created under that account, and we instruct service providers that host or process that data to delete it or stop using it. We aim to finish within 45 days. If the request is complex, we may take up to another 45 days and will tell you.
4. We email you when the request is complete, or if we must keep or refuse part of it and why.

The same email addresses and timing apply to access, correction, and portability requests in Section 11.

8.3 What deletion does not remove

Short-lived backups, which are overwritten in the normal backup cycle after the active copy is deleted. Records we must keep for law, tax, accounting, fraud prevention, a security investigation, or app-store purchase rules. Information you already exported, downloaded, or shared with someone else. Data that remains in a third-party app or health platform you connected. A separate FondCircle account that belongs to someone else. Deleting your account removes dependent profiles you created under it. It does not delete another person’s own account.

9. Security

We use reasonable administrative, technical, and organizational measures, including encryption in transit and access controls. No system is perfectly secure. Protect your password and device lock.

10. Children

The App is not directed to children under 18, and we do not knowingly allow them to create their own account. If you believe a child registered, contact us and we will delete the account. Dependent profiles created by an adult account holder are the account holder’s responsibility.

11. Your rights

Depending on your state, you may request access, correction, deletion, portability, and to limit use of sensitive personal information to what is needed to provide the App. Account deletion, and requests we cannot complete inside the App, follow Section 8.2. We will not discriminate against you for exercising these rights.

California (CCPA/CPRA): We do not sell personal information. We do not share Health and Wellness Data for cross-context behavioral advertising. You may ask us to limit sensitive personal information (including Health and Wellness Data and precise location, if collected) to purposes necessary to provide the App. Submit requests to privacy@fondcircle.com. We may take up to 45 days, extendable as the law allows.

EEA/UK: If those laws apply, we typically rely on contract, consent (health data, optional integrations, AI features, marketing), legitimate interests (security and de-identified improvement), and legal obligation. FondCircle is based in the United States; data may be processed in the U.S. and other countries where processors operate.

12. International users

The App may not be available in every country. If you use it from outside the United States, you understand that your information may be processed in the United States.

13. Changes

We may update this Notice and change the date above. For material changes we will notify you in the App or by email, and obtain a new consent when required.
